1. Terms and Conditions

Please read these terms and conditions in full before using our website. By using this site and registering to purchase any items from The Fertility Medication Centre (TFMC) you are agreeing to understand and accept our terms and conditions.

TFMC is the administrative arm of  The Mediserve Clinic. The TFMC service is provided and invoiced by Mediserve Clinic Ltd.

The Fertility Medication Centre and any associated parties exclude any liability, including that of negligence, for the content or products from the The Fertility Medication Centre website or any products sold through it, to the maximum extent permitted by the law of the United Kingdom.
This site provides an invitation to conduct a business transaction. If an order is placed, it is an offer to purchase, which The Fertility Medication Centre may accept or decline in its absolute discretion.

The Fertility Medication Centre and the Users of this website acknowledge that where medication is being supplied from a Prescription sent to The Fertility Medication Centre by the Customer, The Fertility Medication Centre are making no representations on the adequacy or otherwise of the Medication being prescribed for the Customer. Both parties acknowledge that should the Medication being prescribed by your Clinic be incorrect for the Customers needs, the Customer will have no legal recourse against The Fertility Medication Centre and must seek full legal redress from the original Prescribing Clinic. 

Users of this website acknowledge that by contracting with TFMC and the Mediserve Clinic, they will be regarded as a patient of the Clinic. 

1.1 Age Requirements

By making a purchase and continuing to use this site, you represent that you are at least eighteen (18) years of age and you have the legal authority to enter into this Agreement.

The Fertility Medication Centre is incorporated and registered in England and Wales with company number 12728604. The company operates from 27 Wimpole Street, London W1G 8GN. We can be contacted by email to [email protected].

3. Professional Standards

The Fertility Medication Centre partners only with accredited pharmacies and The Mediserve Clinic for the supply  and delivery of medication.

The Mediserve Clinic has been established for over 30 years and is based in Wimpole St in the heartland of London’s most famous medical district and is run by a reputable and experienced Medical Team specialising in Fertility , IVF, Gynaecology and selective medicine.

4. Privacy

Your privacy is very important to us and we comply with the Data Protection Act 1998.
We will use the information you supply to provide you with any products or services you have requested. Your personal information will not be shared with any organisation other than those directly involved in delivering the services you have requested for example, we may need to contact your prescriber regarding any prescription queries. Your contact details will be provided to delivery couriers to ensure an efficient and delivery.

5. Changes to our Website

We take care to ensure that all information available on our website is accurate and regularly updated this can lead to changes being made at any time.

You should check our terms and conditions regularly in case of any changes we make as you are bound by them.

6. Pricing

All prices quoted are in pounds sterling (GBP). Although we take care to ensure that pricing information is always accurate, prices for certain products can change regularly.

If a pricing error has been made or goods are no longer available you will be notified of this by phone or email. If you have placed an order and the product is no longer available you will have the option to cancel your order without any charge or to continue with your order at the new price. Vat where applicable is charged at 20 percent in accordance with UK law.

Quotes provided by The Fertility Medication Centre are based on the information you provide on the prescription and are not binding until payment has been received.

7. Delivery

All deliveries are made by our accredited pharmacies either through their own couriers or via third party courier companies. 

All deliveries require a signature on receipt. our accredited pharmacy will arrange a suitable delivery date with the customer at the time the order is placed. The order will be processed and delivery will be arranged on the agreed date to the address specified by the customer.

The customer must ensure that they or an authorised person are available to accept delivery of the parcel on the date and address agreed, if delivering to a third party address we recommend prior permission be taken from the addressee.

If any changes are made by the customer to the delivery date or address after this time directly with the courier company our accredited pharmacy or The Fertility Medication Centre will not be responsible for any delays or inconveniences which may be caused. We strongly advise that no changes are made to the delivery by the customer with the courier company. If such circumstances do occur please contact our customer services representatives who will assist.

If a delivery has not been received within the time frame advised, please contact a member of the team at your earliest, who will then be able to assist with locating the delivery.

Deliveries are made Monday-Friday, Saturday deliveries are available upon request and additional charges will apply.

Deliveries to hospitals, military bases and business addresses will be delivered to a main reception or mailing room prior to internal distribution therefore we must recommend against delivering to these address types. If damages or delays are experienced due to the internal distribution process of these delivery types we cannot be held responsible.

8. Force Majeure

Neither party shall be liable for any delay in performance or failure to perform any of its obligations under this agreement insofar as the delay or failure due to any to any event beyond the reasonable control of that party.

9. Storage

Most medications have special storage requirements. It is the responsibility of the customer to open and check all storage instructions for the medications as soon as the order has been received.
Certain packaging and materials will be used to keep fridge items cool and within the recommended guidelines provided by the manufacturer, validated data on the packaging used can be provided if requested.

As with all medications, you should always read the label of any products you purchase so you may ascertain how to store each item and also any risks associated. Please consult your doctor before taking medications you have not had previously and similarly if you experience any major side effects.

10. Errors/Claims

On receipt of your order you should check the contents immediately. If you have any queries regarding the contents or feel there may be an error with your order you must contact a member of the accredited pharmacy team immediately. If any of the contents are damaged or missing we must be informed of this within 24 hours from receipt of your order. Any claims made after this time may be dismissed.

Our accredited pharmacy will not accept returns or process any refunds for prescription medications unless these have been sent to you in error.

11. Your Right to Cancel

Cancellations can only be made if the order has not yet been processed. Once an order has been dispatched it can no longer be cancelled.

If our accredited pharmacy have ordered a non-stocked prescription item to fulfil your order and you decide to cancel this, you will be required to pay for the item in full if it cannot be returned to the supplier.

11.1 Refund Exclusions

Unfortunately, you cannot return prescription medicines, or anything that has a hygiene seal that has been broken. You have the right to reasonably inspect your items as you would in a shop, but you cannot return items that you have used, unless you are returning them because they are damaged or faulty.

12. Links to other Websites

The Fertility Medication Centre may provide links on this site to third party websites. These links are provided for information purposes only and we have no control over their contents. The Fertility Medication Centre has no liability over these websites and we strongly advise that you read the terms and conditions to these sites before making any purchases with them.

13. Governing Law

Any contract to which these conditions apply shall be governed by and construed in accordance with the Laws of England. The parties submit to the exclusive jurisdiction of the English Courts.

14. Feedback/Complaints

At The Fertility Medication Centre we aim to provide high standards of service to our customers, and we appreciate that there may be times where you want to share your feedback, suggestions or complaints.

If, for any reason you are dissatisfied by our service, please contact us. A member of our team will fully investigate the issue and you will receive a detailed response and resolution to your complaint.
